1. Acceptance of These Terms
By creating an account, browsing Jobpify, posting a job, or applying for one, you agree to these Terms and Conditions. If you do not agree, do not use Jobpify.
If you are using Jobpify on behalf of a company, you confirm that you have the authority to bind that company to these terms. The words "you" and "your" refer to both you personally and the company you represent.
These terms form a legally binding agreement between you and Jobpify. They apply regardless of how you access the site — web, mobile, API, or any future interface.
2. Who We Are
Jobpify is a global job board operated from Canada. We connect job seekers with employers by aggregating listings from publicly available job APIs and allowing employers to post directly on our platform.
Jobpify is not an employment agency, a staffing firm, or a recruiter. We do not screen candidates, verify employers, or participate in hiring decisions. We provide the platform; the hiring happens between you and the other party.
What this means in practice
We do not interview candidates. We do not negotiate salaries. We do not guarantee that any job listing is legitimate, or that any candidate is qualified. Those responsibilities belong to the employers and candidates themselves.
3. Your Account
To post jobs, apply for roles, or save searches, you need an account. You agree to:
- Provide accurate, current, and complete information when registering.
- Keep your password confidential. You are responsible for everything that happens under your account.
- Notify us immediately at security@jobpify.com if you suspect unauthorized access.
- Not share your account with anyone else, or create accounts on behalf of others without permission.
We may suspend or terminate any account that violates these terms, provides false information, or is used for spam, fraud, or abuse. We will tell you why, unless doing so would compromise an investigation or violate the law.
You can delete your account at any time from your account settings. When you delete your account, your profile, applications, and messages are permanently removed within 30 days, except where we are required by law to retain certain records.
4. Content You Post
"Content" means anything you upload, post, or submit to Jobpify — job listings, resumes, cover letters, profile information, messages, images, reviews, and feedback.
You own your content. Posting it on Jobpify does not transfer ownership to us.
However, by posting content, you grant Jobpify a worldwide, non-exclusive, royalty-free, transferable, sub-licensable license to use, reproduce, display, distribute, and adapt that content solely for the purpose of operating and improving Jobpify, and promoting the platform. This license ends when you delete your content or your account, except where we have already shared it with employers you applied to, or where the law requires us to retain it.
What this license does NOT allow us to do
We do not sell your content to third parties. We do not use your resume for advertising. We do not claim ownership of your profile. The license exists so we can display your listing to candidates, or show your resume to an employer you applied to — nothing more.
You confirm that you own or have permission to use everything you post, and that your content does not infringe anyone else's rights, violate any law, or contain viruses or malicious code.
We may remove any content that violates these terms or that we believe is harmful, illegal, or misleading — but we are not obligated to monitor or pre-screen content posted by users.
5. Rules of Conduct
You agree not to use Jobpify to:
- Post discriminatory job listings. This includes any listing that discourages applicants based on race, color, religion, sex (including pregnancy, gender identity, and sexual orientation), national origin, age, disability, genetic information, or any other protected characteristic. The only exception is a genuine occupational requirement permitted by law.
- Post false, misleading, or deceptive information.
- Post jobs that do not exist, or that require candidates to pay for training, equipment, or tools upfront.
- Harass, threaten, or abuse other users.
- Scrape, crawl, or harvest data from Jobpify without written permission.
- Attempt to access accounts, systems, or data that do not belong to you.
- Upload viruses, malware, or any code designed to disrupt the platform.
- Use Jobpify for any illegal purpose, or to violate any applicable law.
Violations may result in immediate account termination and, where appropriate, referral to law enforcement.
6. Job Listings and Applications
Employers are solely responsible for the accuracy, legality, and truthfulness of their job listings. By posting a listing, you confirm that:
- The job is a genuine, currently available position.
- You are authorized to post on behalf of the company named in the listing.
- The listing complies with all applicable employment laws in the location where the job is based.
- A salary range is provided. This is mandatory on Jobpify.
Job seekers are solely responsible for the accuracy of their profiles and resumes, and for exercising reasonable caution when applying to or communicating with employers.
The hiring is between you and them
Jobpify does not verify employers, does not screen candidates, and does not participate in any hiring decision. We are not responsible for the outcome of any application, interview, or employment relationship.
We may remove any listing that violates these terms, without refund, and may suspend the employer's account.
7. Payments and Refunds
Employers pay a fee to post jobs on Jobpify. Payment is processed through our third-party payment providers (Stripe, PayPal, or others). By paying, you agree to their terms as well.
Refunds:
- Full refund if the listing has not yet gone live.
- Full refund if the listing went live but received fewer than 5 genuine applications in the first 7 days, requested within 14 days of purchase.
- Case-by-case for all other situations, handled within 14 days of purchase.
Refunds are issued to the original payment method. Processing time depends on your bank or card issuer.
Subscription plans renew automatically unless cancelled. You can cancel anytime from your billing dashboard. Cancellation stops future charges but does not refund the current period.
8. Privacy and Data Protection
Our full Privacy Policy explains how we collect, use, and protect your personal information. It is incorporated into these terms by reference. In short:
- We collect only what is needed to operate Jobpify and match candidates with jobs.
- We do not sell your personal data to third parties.
- We use cookies for functionality and privacy-respecting analytics. You can control them from your cookie preferences.
- You can export or delete your data at any time from your account settings.
Global data protection: Jobpify aims to comply with data protection laws worldwide, including:
- GDPR (EU/UK) — we act as a data controller for account data, and as a data processor when handling applications on behalf of employers. We honor your rights to access, correct, delete, and port your data.
- CCPA/CPRA (California) — we do not sell personal information. You have the right to know what we collect, to delete it, and to opt out of sharing.
- PIPEDA (Canada) — we collect personal information with consent and use it only for the purposes disclosed.
- Quebec Law 25 — we provide explicit consent mechanisms, privacy impact assessments, and designate a privacy officer.
If you are in a jurisdiction with privacy laws not listed here, contact us and we will tell you what applies.
9. Limitation of Liability
Jobpify is provided "as is" and "as available." We make no warranties, express or implied, about the platform's reliability, accuracy, or fitness for any purpose.
To the maximum extent permitted by law
Jobpify and its founders, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or business interruption — arising from your use of the platform, even if we were advised of the possibility of such damages.
Nothing on Jobpify constitutes professional advice. We do not guarantee that using the platform will result in a job, a hire, or any specific outcome. Employment decisions are made solely by employers and candidates.
Where applicable law does not allow the exclusion of certain warranties or liabilities, our liability is limited to the maximum extent permitted.
10. Disputes and Governing Law
These terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
Informal resolution first. Before filing any formal claim, you agree to contact us at legal@jobpify.com and attempt to resolve the dispute informally for at least 30 days.
Arbitration. If informal resolution fails, any dispute arising from these terms or your use of Jobpify shall be resolved by binding arbitration in Ontario, Canada, under the rules of the ADR Institute of Canada. The arbitrator's decision is final and enforceable in any court of competent jurisdiction. You and Jobpify each waive the right to a trial by jury or to participate in a class action.
What this means for you
Instead of going to court, disputes go to a private arbitrator. This is faster and cheaper for both sides. It is also the standard approach used by most global platforms, including ZipRecruiter and Salesforce [citation:19].
Nothing in this section prevents either party from seeking injunctive relief in court to protect intellectual property or confidential information.
11. Changes to These Terms
We may update these terms from time to time. When we do, we will:
- Post the updated version on this page.
- Update the "Last updated" date at the top.
- Notify registered users by email if the changes are material.
Your continued use of Jobpify after changes take effect means you accept the new terms. If you do not agree, you can close your account at any time.
